1. About these terms and about us
These terms govern your use of the Rising Sun Classics website, including vehicle listings, auction information, account features, saved vehicles, alerts and enquiry forms. They apply whether you browse the website, create an account or contact us.
This website is operated by Rising Sun Cars, trading as Rising Sun Classics (referred to as “we”, “us” or “our”).

These website terms are separate from any written quotation, sourcing instruction, auction instruction, purchase contract, transport agreement or other transaction-specific terms. The transaction-specific document will explain the service, parties, price, payment schedule and any special conditions.
2. Using the website
You may use this website for lawful personal or business enquiries relating to vehicles, sourcing, auctions, imports and associated services. You must be at least 18 or have the permission of a parent or legal guardian to use a paid service.
You must not misuse the website, attempt unauthorised access, introduce malicious software, scrape protected content at scale, interfere with its operation, impersonate another person or use it in a way that infringes another person’s rights.
We may suspend or restrict access where reasonably necessary for security, maintenance, suspected misuse or a breach of these terms. We may update, withdraw or change website content without notice.
3. Listings, prices and auction information
Vehicle descriptions, photographs, mileage, specifications, auction grades, estimates and availability are provided for general information. Some information is supplied by auction houses, owners, manufacturers or other third parties and may change or contain errors. Images may be illustrative or may show a vehicle before transport, preparation or repair.
A listing, an auction catalogue entry, a saved vehicle, an alert or an enquiry is not a binding offer, reservation or promise that a vehicle will be available. A vehicle may be withdrawn, sold, fail inspection, fail to meet an auction house’s conditions or become unavailable before a transaction is confirmed.
Any displayed price or estimate must be checked against the written quotation for the relevant transaction. Unless expressly stated otherwise, a price may not include auction fees, our service fee, transport, insurance, storage, inspection, export or import charges, customs duty, VAT, registration, road taxes, repairs or optional services. Where a price depends on a currency conversion, the applicable rate and charges will be stated in the quotation or transaction confirmation.
You should inspect the vehicle-specific information and ask questions before authorising a purchase or bid. Auction grades and reports are not guarantees of condition, future reliability, roadworthiness or title.
4. Auction and sourcing services
Where you ask us to source or bid for a vehicle, we may act as an intermediary or sourcing agent rather than as the vehicle’s manufacturer or auction house. The exact role, authority, budget, fees, required deposit and the identity of the seller or auction house will be set out in the transaction documents.
We will not place a bid or commit you to a purchase unless we have received your clear instructions and any payment or security required by the written terms. A bid may be binding under the rules of the relevant auction house. You are responsible for checking that your instructions, maximum budget, vehicle specification and contact details are correct.
We may decline an instruction, stop pursuing a vehicle or refuse a bid where information is incomplete, the vehicle or seller cannot be verified, the budget is exceeded, compliance checks are not satisfied, or the auction house changes its conditions.
The auction house’s rules may apply to the bid and the vehicle purchase. If those rules conflict with these website terms, the auction-house rules govern the auction transaction and the written agreement with us governs our services.
5. Import, transport, inspection and registration
Import and delivery times are estimates unless a written transaction document expressly guarantees a date. Delays may result from shipping schedules, ports, customs, weather, inspections, documentation, authorities, suppliers or events outside our reasonable control.
You are responsible for giving accurate delivery, identity and registration information and for providing documents reasonably required for export, import, customs, insurance or registration. You must comply with the laws and requirements of the destination country, including roadworthiness, emissions, registration, tax and insurance rules.
Unless a written agreement says otherwise, we do not guarantee that a vehicle will be suitable for registration, use or import in a particular country. Third-party transporters, inspectors, customs agents, auction houses and other suppliers may have their own terms and liability limits.
6. Enquiries, orders and payment
Submitting a form, creating an account, saving a vehicle or requesting information does not itself create a contract or obligation to buy. A contract is formed only when the relevant written terms or order confirmation have been accepted by both parties.
Before you are bound by a paid transaction, we will provide the information required for that transaction, including the service or vehicle description, the trader’s identity, the total price or how it is calculated, additional charges, payment arrangements, delivery arrangements and any applicable cancellation rights.
You must pay invoices and deposits by the due dates in the transaction documents. If a payment is late or fails, we may pause the service, withhold delivery or cancel the instruction to the extent permitted by law and the transaction terms. We will not charge optional extras unless you have agreed to them.
We may carry out reasonable identity, fraud, sanctions and source-of-funds checks. We may refuse or delay a transaction where those checks cannot be completed.
7. Consumer cancellation and statutory rights
If you are a consumer and enter into a qualifying distance or off-premises service contract, you may have a statutory 14-day right to cancel. We will provide the required cancellation information and instructions for the specific contract. You may cancel by sending a clear statement to [email protected]; you do not have to use a particular form.
The right to cancel may not apply to every transaction. Depending on the contract, exclusions may include a public auction contract, goods made to your specifications, services fully performed at your request after the required acknowledgement, or services whose performance has started at your express request with the required information about cancellation charges.
Nothing in these terms removes or restricts rights that cannot lawfully be excluded, including statutory rights relating to the quality, description, fitness, delivery and conformity of goods or services. If a cancellation or statutory remedy applies, the transaction-specific terms will explain the process and any lawful costs.
8. Complaints and service problems
Please contact us promptly with the vehicle or transaction reference, a description of the issue and any supporting evidence. We will acknowledge and investigate complaints within a reasonable time and explain the next step.
For goods or services supplied by a third party, we may need to refer the issue to that supplier while continuing to assist you. This does not affect any rights you have against us or the supplier under the applicable contract or law.
If we cannot resolve a consumer complaint, you may seek independent legal advice or use any applicable statutory court or alternative dispute-resolution route. We are not currently agreeing to a specific ADR scheme unless a transaction document says otherwise.
9. Accounts, communications and user content
You are responsible for keeping login details confidential, for activity under your account and for ensuring that information supplied to us is accurate and up to date. Tell us promptly if you suspect unauthorised access.
When you send us text, photographs, documents or other material, you confirm that you have the right to provide it and that it does not infringe another person’s rights or contain unlawful, harmful or misleading material. You give us permission to use it as necessary to provide the requested service, operate the website and handle your enquiry.
Service messages about an account, enquiry or transaction are not marketing. Marketing messages are sent only where permitted by law. You may opt out using the unsubscribe link or by contacting us.
10. Intellectual property and third-party material
The website, branding, layout, text, graphics and original media are owned by or licensed to us and are protected by intellectual property laws. You may view and print reasonable extracts for personal, non-commercial use.
You may not reproduce, republish, sell, commercially exploit or use automated extraction to copy our content without prior written permission. Vehicle images, auction reports, manufacturer marks and other third-party material remain the property of their respective owners.
11. Availability, third parties and liability
We do not guarantee uninterrupted availability or that the website will always be free from errors. We are not responsible for third-party websites, auction platforms, transporters, ports, customs authorities, payment providers or other suppliers, except to the extent that applicable law makes us responsible.
To the fullest extent permitted by law, we are not liable for losses arising solely from reliance on general website information, temporary unavailability, a third party’s act or omission, or an event outside our reasonable control. We are not liable for indirect or consequential loss, loss of profit or loss of opportunity where the law permits that limitation.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory consumer rights, or any other liability that cannot legally be excluded or limited. Consumer liability limits will not be applied where they would be unfair or unlawful.
12. Privacy, cookies, changes and law
Our Privacy Policy and Cookie Policy explain how we use personal data and cookies. Please read them before creating an account or sending personal information.
We may update these terms when our services, technology or legal obligations change. The version published on this page applies from its stated update date. A change will not retrospectively alter a transaction already confirmed unless the law or the transaction terms allow it.
These terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, except that if you are a consumer you retain any mandatory right to bring proceedings in the part of the United Kingdom where you live and any other rights provided by applicable consumer law.
13. Contact
Questions about these terms, a complaint or a cancellation notice can be sent to [email protected] or posted to the address in section 1.
When contacting us, include your name, contact details and any vehicle, auction or transaction reference so that we can identify the matter.
